These Terms & Conditions apply to all orders placed via the PokeIce online shop (the “Seller”). The shop is operated by:

The presentation of goods in the online shop does not constitute a legally binding offer, but an invitation to order. By submitting the order, the customer makes a binding offer. Acceptance takes place through an order confirmation by email or by dispatch of the goods.
All prices are total prices in euros (€). In accordance with § 19 of the German VAT Act (UStG, small-business regulation), no value added tax is shown or charged.
The following payment methods are accepted:
Payment is due immediately upon completion of the order. For certain payment methods (credit card, PayPal, Klarna) a payment-provider surcharge applies, which is shown before the order is completed.
Dispatch takes place within 1–3 business days after receipt of payment. Shipping costs are calculated during checkout based on the destination country and parcel size, and are clearly shown before the order is completed. Free shipping is not offered.
Insured and tracked shipping options (Standard and Express) are available. We ship within Europe only.
The delivered goods remain the property of the Seller until full payment has been received.
The condition of individual trading cards is stated according to the Cardmarket standard in seven grades:
PSA-certified cards are listed separately with their PSA grade (e.g. PSA 9, PSA 10).
For sealed products (booster packs, booster boxes, ETBs, etc.) the condition corresponds to the manufacturer's original condition unless expressly stated otherwise. Used sealed items are marked as such.
Statutory warranty rights remain unaffected. Typical play or storage marks on used single cards that are described accordingly in the product description do not constitute a defect within the meaning of warranty law.
Consumers have a statutory right of withdrawal (§ 312g BGB). The full withdrawal policy can be found on the Right of Withdrawal page.
Special note for sealed booster packs and sealed products:
The right of withdrawal remains in principle. However, if a sealed product (booster pack, booster box, Elite Trainer Box, etc.) is opened after delivery, the value of the goods for return/resale is significantly reduced, because the element of surprise — an essential part of the product — is lost. In this case the customer is liable under § 357 (7) BGB for the loss of value resulting from handling the goods in a way that was not necessary. As the loss of value when opening a sealed booster product generally corresponds to the full purchase price, we strongly recommend leaving products unopened if a withdrawal is being considered.
Individual trading cards (not sealed) may be returned without restriction within the statutory right of withdrawal.
Claims by the customer for damages are excluded, unless otherwise stated in these Terms. This does not apply to damages resulting from injury to life, body or health, nor to damages resulting from the breach of essential contractual obligations (cardinal obligations). In the event of a breach of essential contractual obligations, the Seller is liable only for the foreseeable damage typical of the contract. The limitation of liability does not apply where the damage is caused by intent or gross negligence.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Edingen-Neckarhausen, provided the customer is a merchant or a legal entity under public law. Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall not be affected.
